Types of insurance coverage

Although your case may be worth a large sum of money, the amount of money that you can actually recover generally depends on how much money is available under the applicable insurance policies. Below is a list of the different types of insurance coverage that could be applicable in your case, along with an explanation of how each type of insurance is used.

Liability coverage

This is often referred to as "at-fault" coverage. The purpose is to pay for an injured victim’s damages when the individual insured under the insurance policy was at fault for the auto accident.

Georgia law requires that every liability insurance policy carry a minimum of:


· $25,000 bodily injury liability per person 

· $50,000 bodily injury liability per accident 

· $25,000 property damage per accident 


The amount of coverage provided by the insurance policy is the maximum amount of money that the insurance company will pay if their insured is at fault for the accident.

Bodily injury liability coverage only applies to injuries that an at-fault driver causes to other people. It does not cover any costs associated with injuries sustained by the at-fault driver. 


By the same token, liability property damage coverage only pays for damages that the at-fault driver causes to another driver's vehicle. It does not pay for the damage sustained to the at-fault driver’s vehicle. 



Uninsured Motorist Coverage (UM)

 Uninsured Motorist coverage, often referred to simply as UM, is part of your own auto insurance policy. It provides protection in the event you are involved in a car wreck and the at-fault driver either has no liability insurance or has fled the scene and remains unidentified. Essentially, this coverage helps to pay for your damages when the responsible party cannot.

  Uninsured  Motorist Coverage is optional; however, your insurance company is required by law to offer it to you. If the insurer cannot produce valid proof that you were offered and knowingly rejected this coverage, you may be automatically entitled to at least the statutory minimum of $25,000 in UM benefits.

Uninsured Motorist Coverage obviously applies to the named insured on the policy. Additionally, it will also cover any relative who resides within the same household as the named insured.

Coverage Follows You

Uninsured Motorist Coverage follows the insured. This means that the insured covered while driving or riding as a passenger in their own vehicle and while driving or riding as a passenger in someone else's vehicle. Additionally, the insured is even covered if they are struck by a motor vehicle as a pedestrian or cyclist.

Underinsured Motorist Coverage (UIM) is part of your own insurance policy and provides protection in the event that you are injured in a wreck and the at-fault driver does not have enough coverage to pay for all of your damages. Just like UM coverage above:


  • Coverage is optional
  • Family may be covered
  • Coverage follows you



If you choose to purchase Underinsured Motorist Coverage, you will select either Traditional/Reduced coverage or Add-On coverage. The type of UIM coverage you select will determine how much coverage is ultmately available to you if the at-fault party cannot pay the total value of your case.  

Traditional vs Add-On

Traditional/Reduced

The amount of coverage you purchased is reduced by the amount of the at-fault driver's available coverage. 


Example 1

  • Your case is worth $50,000.00
  • The at-fault driver has $25,000.00 in coverage
  • You have $25,000.00 traditional UIM


The at-fault insurance will pay $25,000.00, leaving you with $25,000.00 in unpaid value. Your $25,000.00 is reduced by the $25,000.00 that the at-fault insurance paid. Therefore, your insurance does not kick in and you are left with $25,000.00 in unpaid value.


Example 2

  • Your case is worth $50,000.00
  • The at-fault driver has $25,000.00 in coverage
  • You have $50,000.00 traditional UIM


The at-fault insurance will pay $25,000.00, leaving you with $25,000.00 in unpaid value. Your $50,000.00 is reduced by the $25,000.00 that the at-fault insurance paid. Therefore, your insurance will pay up to $25,000.00 to cover the full value of your case.

Add-On

The amount of coverage you purchased is added on to the amount of the at-fault driver's available coverage to the extent needed to pay the full value of your claim. 


Example 1

  • Your case is worth $50,000.00
  • The at-fault driver has $25,000.00 in coverage
  • You have $25,000.00 add-on UIM


Your $25,000.00 is added on to the at-fault driver's $25,000.00 for a total of $50,000.00 to cover the full value of your claim. 


Example 1

  • Your case is worth $50,000.00
  • The at-fault driver has $25,000.00 in coverage
  • You have $50,000.00 add-on UIM


Your $50,000.00 is added on to the at-fault driver's $25,000.00 for a total of $75,000.00. However, since your case is only worth $50,000.00, your insurance will only pay $25,000.00 of your $50,000.00 policy.



Add-On Coverage Must Be Offered

The insurance company is required by law to offer you the opportunity to purchase add-on coverage rather than the traditional reduced coverage. If they cannot provide proof that you were offered and knowingly rejected add-on coverage, you are automatically entitled to it. 

Medical Payments Coverage

Commonly referred to as MedPay, this is another optional type of coverage and is used to pay your medical bills up to the dollar amount of coverage that you purchase.


It can be used in conjuction with settlement funds you receive from the at-fault insurance carrier and UM/UIM carrier, and you can even access the funds if you were at fault for the wreck. 


Anyone who is injured while riding in your vehicle will also be entitled to this coverage.
